1. Acceptance of terms

By creating an account or using Threadnest, you agree to these Terms & Conditions. If you do not agree, please do not use the app.

2. Accounts

You are responsible for the accuracy of the information you provide and for keeping your login credentials secure. You may set up an individual account or a shared household account with multiple members.

3. Marketplace

Threadnest connects buyers and sellers of secondhand clothing. We are not a party to any transaction between users and do not guarantee the condition, authenticity, or delivery of any listed item.

4. Donations

Donation matching connects your items with nearby causes and organizations. Threadnest facilitates the match but is not responsible for how a receiving organization uses a donated item.

5. Virtual try-on

Threadnest's virtual try-on feature uses artificial intelligence, including third-party AI models (such as Google's Gemini models), to generate simulated images of a person wearing a garment ("Try-On Renders"). Try-On Renders are computer-generated approximations only.

5.1 No warranty of accuracy

Try-On Renders are not photographs and are not guaranteed to accurately depict how a garment will actually look, fit, fall, drape, or feel on any person, nor its true color, size, texture, or material. Renders may misrepresent, omit, distort, or fabricate details of the garment or the person depicted. Do not rely on a Try-On Render as the basis for a purchase, sale, donation, or any other decision.

5.2 Third-party AI processing

To generate a Try-On Render (or any AI feature in this app, including the Style Assistant and photo cleanup), we transmit the photo(s) and information you provide to third-party AI service providers (including Google, via its Gemini API) for processing. Those providers process this data under their own terms and privacy practices, which we do not control. By using these features, you consent to this transmission and processing.

5.3 Your photos and consent

You represent that you own or have all necessary rights and consents to upload any photo you submit, including consent from any other real person depicted (such as a household member). You must not upload a photo of any person without that person's knowledge and consent, and must not upload a photo of a minor except a minor in your own care with appropriate parental or guardian authority. You are solely responsible for the photos you upload.

5.4 No liability for outcomes

To the fullest extent permitted by law, Threadnest and its officers, employees, and service providers are not liable for any loss, harm, embarrassment, damage, or dispute arising from: (a) inaccuracies, errors, distortions, or unexpected content in a Try-On Render or other AI-generated output; (b) any decision you make in reliance on a Try-On Render or AI-generated recommendation, including a purchase, sale, listing, or donation decision; or (c) unavailability, delay, or failure of any AI feature due to third-party service outages, rate limits, or changes outside our control.

5.5 No professional advice

Try-On Renders and any styling suggestions generated by our AI features are provided for entertainment and general informational purposes only and do not constitute professional styling, fashion, sizing, or purchasing advice.

6. Subscriptions & credits

Subscriptions renew automatically until cancelled. Try-on credits are non-refundable once used and do not expire unless stated otherwise.

7. Prohibited conduct

You may not list stolen, counterfeit, or prohibited items, misrepresent an item's condition, or use the app to harass other users.

8. Liability & indemnification

Threadnest is provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app, including any AI-generated content or any feature relying on a third-party service (including AI image or text generation, location lookup, or payment processing), will be accurate, uninterrupted, secure, or error-free. To the fullest extent permitted by law, Threadnest disclaims all liability for losses arising from marketplace transactions, donation outcomes, or use of any AI feature, and our total liability to you for any claim arising out of your use of the app will not exceed the greater of the amount you paid us in the 12 months before the claim arose, or $50. You agree to indemnify and hold Threadnest harmless from any third-party claim, loss, or damage arising out of your use of the app, content you upload or post, or your violation of these terms.

9. Changes to these terms

We may update these terms from time to time. Continued use of the app after changes take effect constitutes acceptance of the revised terms.
